Terms of Service

By creating an account or otherwise using the Service, you confirm that you are at least 13 years old (or the applicable minimum age in your jurisdiction), that you have read and understood these Terms, and that you agree to be bound by them and our Privacy Policy.

We may update these Terms from time to time. If a change is material we will notify you via email or an in-app notice at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at support@gymrivals.app if you suspect unauthorised access.

You must provide accurate and complete information when registering and keep your profile information up to date. You may not impersonate another person or create an account on behalf of someone else without their permission.

Each person may hold only one account. Creating multiple accounts to circumvent suspensions or challenge rules is prohibited.

You retain ownership of the content you post on GymRivals (workout check-ins, photos, comments, chat messages). By submitting content, you grant GymRivals a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, display, and distribute that content solely to operate and promote the Service.

You are solely responsible for the content you post. You represent and warrant that your content does not infringe any third-party intellectual property rights, violate any applicable law, or contain material that is defamatory, obscene, or otherwise objectionable.

We reserve the right to remove content that violates these Terms or our Community Guidelines at our sole discretion, without notice.

GymRivals allows participants to optionally contribute monetary stakes to fitness challenges. The following rules apply:

• •Age requirement. You must be 18 years of age or older to create or join a money-stakes challenge. We reserve the right to verify your age and suspend accounts that circumvent this requirement.
• •Not gambling. Stakes are a voluntary performance incentive. Winners are determined solely by meeting the objective fitness criteria defined in the challenge rules, not by chance.
• •No refunds. Stakes paid into a challenge are non-refundable once the challenge starts, except at our sole discretion in cases of verified technical errors on our platform.
• •Winnings. Winnings are distributed to your connected payment account (via Stripe) within 5 business days of challenge completion. GymRivals retains a platform fee as disclosed at the time of challenge creation.
• •Taxes. You are responsible for reporting and paying any applicable taxes on winnings in your jurisdiction.

FuelCoins are a virtual in-app currency with no monetary value and cannot be exchanged for cash or transferred between accounts.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. GymRivals is a fitness motivation platform — nothing in the Service constitutes medical, health, or fitness advice. Always consult a qualified professional before beginning any exercise programme.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GYMRIVALS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GYMRIVALS IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

You may stop using the Service and delete your account at any time via Settings → Account → Delete Account.

We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine in our sole discretion that you have violated these Terms, engaged in fraudulent activity, or that your continued use poses a risk to other users or the platform.

Upon termination, your right to use the Service ceases immediately. Any outstanding winnings from completed, verified challenges will still be distributed to you. Unused FuelCoins and in-progress challenge stakes are forfeited upon termination for cause.

Sections 3, 6, 7, and all payment-related provisions survive termination.

Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in English.

You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@gymrivals.app with the subject line “Arbitration Opt-Out”.
